EAR-Regulated Technology & Encryption Product Notice

Certain products and technologies distributed by Gresco Utility Supply, Inc., and its partners or manufacturers, including some offered through its Unmanned Autonomous Solutions (UAS) division, are subject to the U.S. Export Administration Regulations (EAR) and may contain components controlled under encryption or technology-related Export Control Classification Numbers (ECCNs).  Gresco and its customers are required to comply with these regulations, including those imposed by applicable manufacturers.

This notice applies to products identified as controlled under categories such as 5A992, 5A002, or related ECCNs.

Regulatory Classification and Scope

• These products may include encryption functionality or controlled technology subcomponents.
• Classification under ECCN 5A992 (mass market) or 5A002 (restricted encryption) requires compliance with EAR export, re-export, and transfer regulations.
• None of Gresco’s commercial products are subject to ITAR.

Export Restrictions

• Domestic transfers within the U.S. to U.S. Government or Department of Defense entities typically do not require a license.
• Exports or re-exports to foreign defense or government end users may require U.S. authorization unless a license exception applies (EAR §§ 736.2(b)(7), 744.21).
• Exports to embargoed or sanctioned destinations (including China, Russia, Iran, North Korea, Cuba, and Syria) are prohibited without authorization.
• Use in foreign weapons systems, missile programs, or foreign military UAVs is prohibited unless specifically authorized under the EAR.

Permitted End Use

These products are designed for civil and commercial applications such as mapping, surveying, inspection, and photogrammetry.

Responsibility

By purchasing, reselling, or integrating any export-controlled product, the buyer assumes responsibility for compliance with all applicable export control laws, including any re-export requirements.

Recordkeeping

Customers are expected to maintain documentation related to any export, re-export, or transfer for at least five years, consistent with 15 CFR § 762.
